Arbitration Notice / Jury Waiver: These Terms of Use contain an arbitration and class action/jury waiver provision that requires both parties to resolve disputes by binding arbitration. In arbitration, class actions and jury trials are not permitted. Please review the below section carefully, as it governs and affects your rights to resolve disputes with Suburban Propane.

Terms and Conditions for MyAccount Customer Portal

By registering for and using the Suburban Propane MyAccount Customer Portal, you agree to be bound by the following terms and conditions, in addition to and subject to the terms and conditions of any other current agreement you may have with Suburban Propane. If you do not agree to these terms and conditions, you should not complete the registration process. YOUR REGISTRATION FOR SUBURBAN PROPANE’S MYACCOUNT CUSTOMER PORTAL INDICATES YOUR ACKNOWLEDGMENT THAT YOU HAVE READ AND ACCEPTED THESE TERMS AND CONDITIONS AND THAT YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS AND ANY FUTURE AMENDMENTS THAT MAY BE MADE FROM TIME TO TIME.

These terms and conditions shall be governed by the laws of the State of New Jersey, without regard to the conflict of law rules thereof.

You should print and retain this document and any updated or amended terms and conditions for safekeeping and reference at any time during your usage of the online payment services.

General Terms and Conditions. You acknowledge that communications or transactions conducted online are not absolutely secure. You agree to assume all risk and liability arising from your use of Suburban Propane’s MyAccount Customer Portal, including the risk of breach in the security of the communications or transactions you conduct with Suburban Propane through that portal. You further acknowledge that there may be system failures that may limit your ability to use the MyAccount Customer Portal. In the event of a system failure or interruption while using the MyAccount Customer Portal, your data may be lost or destroyed. Any transaction(s) that you initiated, were in the process of completing, or completed shortly before a system failure or interruption should be verified by you to ensure the accuracy and completeness of such transactions(s). You assume the risk of loss of your data during any system failure or interruption and the responsibility to verify the accuracy and completeness of any transactions so affected. SUBURBAN PROPANE’S MYACCOUNT CUSTOMER PORTAL IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE. In no event shall Suburban Propane ever be liable for any direct, indirect, special, incidental, consequential, or exemplary damages, including lost profits (even if advised of the possibility of such damages) arising in any way out of your use of the MyAccount Customer Portal.

You represent that you are of legal age to form a binding contract (at least 18 years old). You agree that Suburban Propane may send you electronic communications related to your use of Suburban Propane’s MyAccount Customer Portal, including, but not limited to, confirmation of payments made, notice of credit card expirations, and other purposes as Suburban Propane deems to be appropriate including, unless you have checked the “NO” box indicating that you do not want to receive promotional emails from us, electronic communications related to special promotions and new product and service features and enhancements offered by Suburban Propane and/or its affiliates.

You are solely responsible for maintaining the confidentiality of your password and agree not to give your password to anyone else. Should you allow others access to your account and/or password information, you will be responsible for all actions that such persons might take with respect to your account. If you believe your password has been lost or stolen or someone has gained access to your password without your permission, call Customer Service immediately at 1-800-776-7263. Unauthorized individuals attempting to access password protected and/or secure areas of the online payment services may be subject to prosecution.

You agree to provide Suburban Propane with current, accurate and complete information required by the online registration process. You further agree to provide Suburban Propane with current, accurate, and complete data when utilizing the MyAccount Customer Portal. You agree to notify Suburban Propane immediately of any changes in your personal MyAccount Customer Portal data. If you have not already done so, we urge you to review our Privacy Policy.

Suburban Propane may at any time and without prior notice make changes to, or discontinue, its MyAccount Customer Portal and/or these terms and conditions, and may require re-enrollment if the portal or these terms and conditions are modified. We will post any such changes on this web site and you are encouraged to access and review these terms and conditions on a regular basis. Suburban Propane may terminate your registration in the MyAccount Customer Portal if, without limitation, we receive conflicting instructions, if your account is in default of this Agreement or otherwise not in good standing, or if we determine that you are using the MyAccount Customer Portal improperly. If Suburban Propane terminates your registration in the MyAccount Customer Portal for any reason, you will need to pay your amounts due to Suburban Propane in another manner. If you register for the MyAccount Customer Portal, it will mean that you agree not to make a claim against Suburban Propane relating to the MyAccount Customer Portal and that you will hold Suburban Propane harmless from any claim, liability or damage resulting from the MyAccount Customer Portal, or your use or inability to use the same, in connection with your account.

To Report an Unauthorized Transaction: Contact Customer Service immediately at 1-800-776-7263, or send an email to MyAccount@suburbanpropane.com.

Online Bill Payment. By supplying the required checking account or credit card information, you authorize Suburban Propane to debit your checking account or charge your credit card for your scheduled payment amount on the date indicated, including any applicable transaction fees. You also authorize Suburban Propane to, upon notification by you or your financial institution, modify and/or update the account numbers, expiration dates, or other pertinent information associated with Online Bill Payment as necessary to complete any authorized transaction. Please review your statement/invoice for accuracy. You understand and agree that Suburban Propane is not liable for incorrect debits to your account resulting from errors on your statement/invoice (see the section below for how you can report errors on your statement/invoice to Suburban Propane). This authorization does not alter in any way the terms and conditions of your customer agreement with Suburban Propane. Suburban Propane is not responsible for any financial institution fees you may incur as a result of your participation in this program.

If any electronic payment is returned unpaid by your financial institution for any reason, Suburban Propane may charge, and you agree to pay, a fee of up to $50 in addition to other bank charges. All charges, terms and conditions are subject to change. PLEASE KEEP THIS AUTHORIZATION FOR YOUR RECORDS.

When making an online payment you will be given the option to store your checking account or credit card information for future payments. If you do not choose this option, you will have to re-enter this information each time you wish to make an online payment. By choosing to store your checking account or credit card information, you authorize Suburban Propane to store such information and use the same to debit your checking account or charge your credit card accordingly, until you cancel this choice by deleting the checking account or credit card previously stored as a payment source. Your payments will automatically be debited from your checking account or charged to your credit card on the specified dates. (If any date falls on a weekend or holiday, the debit will occur on the following business day.)

Notify us in case of errors or questions about your online bill. If you think your online bill misstates the number of gallons delivered to you on the date indicated, does not conform to any pricing formula expressly set forth in your contract with Suburban Propane, contains charges that are not applicable to your account or which you have already paid, or otherwise contains errors in computation, or if you need more information about a transaction on your online bill, write us in a separate letter at the mailing address on your online statement or invoice. Write us as soon as possible. We must hear from you no later than 90 days after we have posted on the website the first bill on which the error or problem appeared. You can telephone us, or send an e-mail, but doing so will not preserve your rights. Upon Suburban Propane’s receipt of your letter, we will promptly investigate. If Suburban Propane confirms that an error has been made, we will credit any amount overpaid to your account.

In your letter, give us the following information:

  • Your name and Account number
  • The dollar amount of the suspected error
  • Describe the error and explain, if you can, why you believe there is an error. If you need more information, describe the item you are not sure about.
  • If you have authorized us to pay your bill automatically from a checking account, you can stop the payment on any amount you think is wrong. To stop the payment your letter must reach us three business days before the automatic payment is scheduled to occur.

SMS/MMS Text Message or Other Communications. In connection with your relationship with Suburban Propane and the use of the Services, you may sign up for receiving calls or text messages (SMS and MMS) from us or our authorized third parties through registration, texting a designated shortcode, or scanning any QR code made available to you by Suburban Propane. BY SIGNING UP FOR TEXT MESSAGES, YOU AGREE AND CONSENT TO RECEIVING MESSAGES AT THE TELEPHONE NUMBER YOU PROVIDE DURING REGISTRATION, EVEN IF IT IS ON ANY DO-NOT-CONTACT LIST (INCLUDING ANY CORPORATE, STATE, OR FEDERAL DO-NOT-CONTACT LIST). You represent and warrant that you are over age 18 and the primary owner of the telephone number provided. You understand and acknowledge that such calls or text messages may be for telemarketing and advertising purposes relating to your use of or access to Suburban Propane product or services. You understand and acknowledge that such messages may be sent by us or our third-party service providers using an automatic telephone dialing system or other automated means (e.g., automated text and/or artificial and/or pre-recorded messaging), and that message and data rates may apply. Message and data rates may apply. MESSAGE FREQUENCY VARIES AND MAY BE SENT AT ANY TIME OF DAY, INCLUDING ON WEEKENDS OR HOLIDAYS.

Unsubscribe at any time by replying STOP or clicking the unsubscribe link (where available). Text HELP for help. To the maximum extent permitted by laws:

  1. all information contained in SMS/MMS text messages is provided “AS IS” without warranty of any kind, either express or implied, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement; and
  2. we expressly exclude any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with the receipt, use, failure of, or inability to use, SMS/MMS text messages. After opting out of receiving text messages, you can re-enroll in any text messaging program available through Suburban Propane by following the instructions for that program. By signing up, you agree to these terms relating to SMS, MMS, or push notifications, as well as the Privacy Policy, which are incorporated herein by reference and can be viewed at the links provided.

Arbitration. For any dispute you have with Suburban Propane, you agree to first contact us and make a good faith attempt to resolve it with us informally. Following that, if you still intend to initiate arbitration, you must first send Suburban Propane a written Notice of Dispute (“Notice”). A Notice from you to us must be emailed to arbitrationnotice@suburbanpropane.com (the “Notice Address”). Any Notice must include

  1. the claimant’s name, address, and email address;
  2. a description of the nature and basis of the claim or dispute;
  3. any relevant facts regarding your use of the services;
  4. a description of the nature and basis of the specific relief sought, including the damages sought, if any; and
  5. a personally signed statement by the claimant verifying the accuracy of the contents of the Notice.

The Notice must be individualized, meaning it can concern only your specific dispute. Upon receipt of a completed Notice, the Parties shall engage in a good faith effort to resolve the dispute for a period of 60 days. If the Parties cannot reach an agreement to resolve the issues identified in the Notice within 60 days after the completed Notice is received, a Party may commence an arbitration proceeding. Compliance with the Notice requirement discussed in this paragraph is a condition precedent to initiating arbitration.

Unless resolved by mutual efforts of both parties, any disputes or claims that may arise out of or in connection with this Terms of Use and for which either party shall seek equitable relief, all differences, disputes or claims arising in connection with this Agreement or any transaction or occurrence contemplated hereby shall be finally settled under the Commercial Rules of the American Arbitration Association (“AAA”) in Morris County, New Jersey by one or more arbitrators appointed in accordance with such rules, except that no punitive damages may be awarded. The parties together understand and agree that the decision in such arbitration shall be final and binding on both parties, and that a judgment upon any award rendered may be entered in any court having jurisdiction.

You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location. Either party may obtain injunctive relief (preliminary or permanent) and orders to compel arbitration or enforce arbitral awards in any court of competent jurisdiction.

CLASS ACTION AND JURY TRIAL WAIVER. YOU AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY LAW, BY ENTERING INTO THIS AGREEMENT, EACH PARTY IS WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION LAWSUIT. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITY IN ARBITRATION, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING, AND, UNLESS WE AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS. THIS MEANS THAT YOU AND SUBURBAN PROPANE MAY NOT PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING BROUGHT BY ANY THIRD PARTY. NOTWITHSTANDING THE FOREGOING, YOU AND SUBURBAN PROPANE MAY PARTICIPATE IN A CLASS-WIDE SETTLEMENT.

You may opt out of binding arbitration and this class action and jury trial waiver by notifying us in writing within 30 days of agreeing to these Terms of Use, unless a longer period is required by applicable laws. Your written notification must be delivered to us at arbitrationnotice@suburbanpropane.com within 30 days after you have accepted these Terms of Use and must include your name, your address, and a clear statement that you do not wish to resolve disputes through arbitration.
